J K Safety Training Ltd Terms and Conditions.
It is assumed that you agree to these terms and conditions when you employ J K Safety Training Limited Reg no 9562851 (Referred to as JKST) as a company or an individual. These terms and conditions take priority and are enforceable over all other operating terms unless sanctioned in writing.
General Operating Terms
Payment of invoices
Invoices are sent on confirmation of order and, unless otherwise agreed, a deposit amount will be required to reserve a booking date and the remaining balance will need to be made at least 2 weeks before training is to commence. If you book a course where the start date is less than two weeks away- full payment will be required upon booking. If no deposit (or full payment if start date is less than two weeks away) is paid within 24 hours of correspondence the dates may be given to another customer.
Cancellations
Full cancellation of a course must be emailed over No Later than two weeks before the course start date- Please be advised that a £50.00 admin fee will be deducted from your deposit before it is refunded.

Title of goods
JKST reserve the title of all goods and certificates supplied to customers until paid in full.

Candidates fitness to train.
JKST follows the guidelines laid down in the ACOP 117, Nambex & ALLMI accredited training standards.
Medical considerations
Candidates selected to operate a MHE should be free from disabilities, either physical or psychological, that might pose a threat to their own health and safety or the safety of others who might be affected by them operating a MHE. Fitness for operating should always be judged on a case-by-case basis. A risk assessment may be needed to identify any hazards associated with a candidate being trained by JKST.
Alcohol and Drugs
JKST Never allows anyone who is unfit because of alcohol or drugs (prescription or recreational) to train or operate even under close supervision. All candidates who undertake training with JKST must declare anything that may affect their ability to training/driving before the start of any period of Instructor Supervised training. JKST may require its candidates to sign a declaration to this effect at the start of all our courses.
Disability’s
Candidates may have developed skills which compensate for their disability. JKST may consider obtaining medical advice prior to the start of any course about a candidates suitability for the particular training they will be required to do with regard to training. The Equality Act 2010 will be considered in all cases.
The Drivers’ Medical Unit at the Driver and Vehicle Licensing Agency (DVLA) publishes At a glance: Guide to the current medical standards of fitness to drive. This is aimed at health professionals and applies to lift trucks on the road, but can be applied to all work with lift trucks. For most work with lift trucks, a standard of fitness equivalent to that for the Group 1 entitlement (ordinary driving licence holders) would be appropriate. Activities such as working in a particularly demanding environment, working at night or moving highly toxic or explosive materials would probably be more appropriate to the Group 2 entitlement (heavy goods vehicle licence holders).
JKST may ask to apply a pre-operators experience test to avoid wrong advice being given to a candidate with regard to disability’s and the training we can offer.
Instructors Discretion
Please note that candidates may, sometimes, not meet the standard expected to pass the required practical or theoretical tests. On these occasions’ instructors may recommend that further training is required, or the candidate is unsuitable for training for whatever reason.
Instructors may abandon a course if they feel the environment is not safe to train in, the work equipment is not in a safe condition, the candidate/s are not available to train for an unreasonable amount of time or they are physically or verbally abused by anyone that is on site.
Instructors may take a candidate off a course for several reasons:
· If they feel the candidate is under the influence of drugs or alcohol
· The candidate is operating in a manner that could put the instructors or other candidate’s health and safety at risk.
· The candidate is acting in an aggressive manner verbally or physically.
· The candidate is progressing slower than another candidate and the instructor feels they are being detrimental to other candidates training.
JKST will support their instructors on their decisions fully and no refund from the course will be given. If further training is recommended, then this will incur further charges.
General Consideration regarding….
On-Site Instructor Training
Training area provided by the firm:
All training is to be carried out “off the job”. This means that the instructor and trainees, together with the MHE and loads, should be wholly concerned with training Ideally kept away from normal commercial operations, and not be diverted to other activities while training is in progress.
Weather conditions
Must be ‘conducive to training’ in the opinion of the instructor. This means in principal a comfortable ambient outside temperature with little or no dominant effects on verbal communications or practical demonstrations from Rain, Sun, Ambeiant Heat/Cool, or Wind. In no case will we work in Zero or Minus temperature. As measured in windchill factoring.
Training Statements
Trainability assessment & competence testing
If in the opinion of the instructor/examiner any trainee is considered to be unsuitable for the course, they will be made aware of this and a full invoice fee will be charged ( and the cost of expenses if applicable).
Public liability/indemnity insurance
J K Safety Training Limited is fully covered for public liability on customer premises.
Accreditation
JKST is subject to monitoring visits by ALLMI training ltd & Nambex and is a recognised provider of their courses. It is also subject to ACOP training standards.

As a candidate being trained by J K Safety Training Ltd we require you to read our GDPR Notice outlined below.
In accordance with the General Data Protection Regulations (2018), J K Safety Training Ltd is committed to processing data fairly and lawfully. This relates to data collected about our employees, suppliers, and customers.
That is why, as a CANDIDATE we promise to:
J K Safety Training will collect data from you and your employer/booking agent. If you have been booked with us through a third party we will assume that they have your consent to process and submit your personnel data for the purposes of booking your training and relevant appointments.
What information we collect and how it is stored
Once a booking has been made with us, we will collect certain information from yourself and/or employer/booking agent for the purpose of carrying out our business with you. This information may include:
We will hold any information securely on our systems for the duration of your training with us. After this time, unless you have ‘opted in’ to future correspondence, the information will be destroyed securely.
Who we share information with and why?
As part of your booking with us, it may be necessary for us to share your details with companies outside of J K Safety Training Ltd.

Candidate Record sheets
A record of operator training will be kept up to six years by J K Safety Training or a third party training provider to comply with relevant guidance by HSE. After this period documentation will be destroyed
Social Media
We are proud of all our students who obtain their licences and have trained hard to get them. On occasions our instructors may ask to take pictures of you whilst training or once you have completed your test. J K safety Training Ltd may share these pictures on its social media platforms such as Facebook, Twitter, LinkedIn and Google+ and other platforms. We may also use the images for promotional material or for use on our website in future.
We will not take any pictures without your knowledge or consent. By allowing us to take a picture you agree your consent and that of your employer/booking agent (if applicable) that the image is the property of J K Safety Training ltd and can be used in the capacity detailed.
You have a right to contact us at any time after consent and or photo is taken and published and ask for it to be removed and destroyed.
Marketing Preferences
We feel it’s important to keep our customers up to date with news, whether it be from us, or other industry organisations or to contact you to remind you of upcoming expiry dates of your tickets, but we understand that once your training with us finishes you may prefer not to receive such news you may opt out at anytime by emailing jkstbookings@gmail.com

Commitment to Professional Operating Standards
JKST will at all times work within and develop courses that conform and comply with the Health and Safety at Work act 1974, taking into account relevant regulations and appropriate Codes of Practice. Designing, packaging and using professional courses that will not knowingly cause any conflict within the working influence of the training that is being undertaken with regard to health and safety.
Fees
JKST fees are always competitive for what we provide, which is high quality, tailored, specialised service. As such will not generally offer arbitrary discounts; generally, a reduction in price is only enabled by reducing the level or extent of services to be delivered. That said, JKST always try to propose solutions which accommodate our clients’ available budgets and timescales. Wherever possible JKST will agree fees and basis of charges clearly in advance, so that JKST and our clients can plan reliably for what lies ahead, and how it is to be achieved and financially justified.
Professional conduct
All Instructors staff or subcontractors working on behalf of JKST will conduct all of their activities professionally and with integrity.
Additional Operator Training Terms & Conditions for ALLMI Lorry loader Courses.
1.Vehicle
1.1 Must be in good working order and conform to current legislation.
1.2 Boom Height Indicator must be operational.
1.3 PTO engagement indicator and interlock must be operational.
1.4 Vehicle must be available throughout the training session.
2.Loader
2.1 Must be in good working order.
2.2 Must have a current Report of Through Examination, a copy of which must be provided before training commences.
2.3 All safety features must be operational and conform to current legislation.
2.4 Must be fitted with correct attachment for type of training required.
2.5 Must have the manufacturer’s Operator Manual.
2.6 The maximum rated capacity of the loader used for training will determine the size of loader the operator will be certificated to use, assuming all assessments are passed successfully. For this reason it should be ensured that the loader set aside for training falls into the ALLMI category that the operator wishes to be licensed for. If you are not familiar with the ALLMI categories system then please contact us.
3.Lifting Gear / Attachments
3.1 All lifting gear / attachments must be in good condition.
3.2 Lifting gear must be appropriate for the type of load being lifted.
3.3 Lifting gear must have a current Report of Through Examination, a copy of which will be required before training commences
3.4 All lifting accessories / attachments must have rated capacity information attached.
4.Working Area
4.1 A working area equivalent to the loader’s maximum reach throughout its full slewing range plus two metres must be provided.
4.2 The working area must be cordoned off. No other persons apart from the instructor and candidates should be in this area.
4.3 The area should be firm, level, and free from obstructions (overhead power lines, buildings, underground services, etc).
4.4 Loads to be manoeuvred must be in this area before the practical session begins.
5.Classroom
5.1 A classroom dedicated to training,must be provided, which should comfortably accommodate seating the required number of candidates and instructor, as well as an ALLMI auditor. The classroom must have adequate heating/ventalation lighting and power points.
5.2 If available, the following equipment should be provided:
5.2.1 Overhead Projector.
5.2.2 Overhead Projector Screen.
5.2.3 Flip Chart / Write On Board.
5.3 The classroom must be available throughout the training session for the Instructor & Candidates only.
6.Participants
6.1 All participants must be advised of the training before the day of commencement.
6.2 If possible, prior knowledge of the equipment would be advantageous.
6.3 Each participant to supply Personal Protective Equipment; Hard Hat (no Bump Caps); Safety Footwear; High Visability Jacket/ Waistcoat; Gloves
6.4 Failure to produce the above on the day of training will result in exclusion from course. Costs paid or those to be invoiced will not be refunded.
7.Numbers
7.1 Experienced operators – Maximum 4
7.2 Inexperienced operators – Maximum 4
General Definitions
Basic day rates
ALLMI day rate is for second day training for the instructor.
Number of candidates
ALLMI numbers can vary depending on specific courses and the number of attachments to be certified.
